No. You are assuming that if a player abuses ECD, he's going to always be in situations where you can fairls apply other penalties. You then follow it up by saying that even if the situation *doesn't* warrant it, you can find a way to make it to!
The "loophole" is the fact that a player can choose to treat SR4 like a video game, instead of a RPG.

I've said it before, and I'll say it again:
"Escape from Certain Death" still entails GM-arbitrated side effects. Therefore, it is only abusable if the GM allows it to be.
