Possessing a counterfeit controlled substance(a substance a reasonable person would believe to be a controlled substance) will get you 6 months in jail. Intent to sell will get you a year and a half. If you are facing that kind of prison time, might as well sell the real things.
And don't try to rules lawyer your way out of "what a reasonable person would believe." That gets into the realm of actual lawyer.
EDIT: In Colorado, it's a class 5 felony, meaning 1 to 3 years and a 1k to 100k fine. A second offense is a class 4 felony, meaning 2 to 6 years and 2k to 500k fine. Even more if you sell it to a minor. Possession and intent are the same for sentencing purposes in Colorado.
