It was intensive, but I made it through this entire thread finally! On the way, I discovered many pony things I had not, and rediscovered others I had forgotten. Foremost among the discoveries must be Fluffle Puff.

A question though, does anyone know what has happened to the Friendship is Witchcraft videos? They all seem to have been pulled down. The series and songs in it are absolutely amazing.

And now for a challenge:

What, seriously?

When did they turn to the Dark Side?

Did the evil lawyers department get unleashed by mistake? They have to realize that actively antagonizing the part of their fanbase that is actually in voluntary control of its own purchasing power is a bad idea, don't they?

I don't know. The last posts they put up (that I read) indicated that they don't know either, and no one else seems to have been targeted. But they're still working on stuff, and still posting it, which is great, because I love it.

Hasbro has to defend their copyrights when stuff's brought to their attention, or risk losing them. It's like the fan games, they generally turn a blind eye until someone either starts trying to make money or starts getting enough press it might be confused for an official product.

Indeed, however, Hasbro isn't doing the same with the hundreds of other fan series, including the FiM Warhammer art, the FiM fiction series, the FiM 'mental instability' videos, the TONS of FiM music videos. I"m only aware of two cases; the FiM video game (which did involve money changing hands, so Hasbro was totally justified) and Friendship is Witchcraft. Since FiW is a parody, it's actually PROTECTED by the 1st Amendment, and one of the few instances where suing them is clearly wrong.

Maybe Hasbro was jelly that they were actually making far better music than the actual series was.

Minor nitpick, it's trademark that can be lost through non-action, not copyright.

However, this can be handled in a fan-friendly manner with limited open licensing agreements. "You agree to these terms and conditions on usage and must place this text on your work, etc."

Parody of a copyrighted work is one thing, and much easier to do. Parodying a trademark is an exceedingly higher bar to cross as you must violate the trademark by first making the viewer think it's the trademark owner's product and simutaneously make it obvious that it's not the trademark owner's product. The problem, and the reason why they're undoubtedly infringing on a trademark while other fan series aren't, is using the "Friend is <blank>" expression in the title. The original series is video. FiW is video. There's not sufficient difference to indicate that the one is not actually a product of Hasbro. Combine this with a possibly negative <blank> expression, like Witchcraft, which could cause damage to their product and it doesn't surprise me that Hasbro decided to act.

As for examples. Chewy Vuiton is a chew toy which parodies Louis Vuitton. It look a lot like a Louis Vuitton handbag. This particular trademark parody was held as fine because it wasn't likely to be confused with the real product as Chewy Vuiton would be sold in pet stores while Louis Vuitton handbags are sold in department stores and Louis Vuitton outlet stores.
nezumi
In that case, perhaps Hasbro should just inform FiW that is the case, so FiW can change the name instead of shuttling their videos around like the black market pony propaganda they now are.

This would seem to be simple enough to me. Add a "Totally not affiliated with Hasbro" watermark at the bottom of their opening or whatever.

Also, proper Friendship is Magic airs on The Hub, a television channel, whereas FiW does not 'air' at all, it is distributed over internet channels such as YouTube.

The problem is really that Hasbro has money and lawyers. Protection of parody breaks down when the parodying organization is a tiny minnow who will be destroyed simply by attempting to defend themselves in court, even when they're 100% in the right.

However, FiW doesn't use original art, just Hasbro works with occasional small modifications and new voiceovers.

If they were animating their own work, they'd have more of a leg to stand on as far as why they're getting hit and other fanart isn't.

Search for PMV on youtube. The majority use only Hasbro material, plus voice-over.

Yeah, and just like FiW, youtube gets takedown notices on them if they draw enough attention that Hasbro notices.

Thus the nature of modern copyright law.

It was...

No.

No, it isn't.

It's like they took everything charming about FiM, tossed it out the window, and replaced it with Generic Highschool Teen Drama #87512.

Plus, the character designs are awful.

I'm a little leery, but looking forward to it. The series' story editor as of Season 3, Meghan McCarthy, was also the one who wrote EQG. After seeing that, and how hit or miss S3 was, I'm not sure if she's actually up to the task of getting all the episode writers on the same track and making a good season happen. Rob Renzetti is a really hard act to follow, he's been instrumental on a ton of really good animated works.

Really, that's the biggest thing that I think set MLP:FIM up to be good. Faust, Renzetti, and the writers they started with were all experienced in making 'kids' shows' that had wider appeal, and they brought in other people they knew who'd worked on stuff like Foster's Home For Imaginary Children, Samurai Jack, and the like to get a talented team. A lot of them have moved on to other projects since, though.

We'll see. At the very least, there'll be more songs, and those are almost always excellent. They were teasing a S1/S2 official soundtrack release yesterday as well.

MLP: Shooting People In The Face Is Magic?
Stahlseele
No, quite a bit more Grimdark i am afraid.
The base premise is that equestria is a meta plane. And due to there being close to no death or famine or anything like that over there, the food gets scarce. so when a magician (yet to be determined) stumbles upon that plane and unwittingly alerts them to our presence, some of them come over in search for food. inhabiting the shadowrun versions of Earth-Ponies(German Troll Sized Horses), Pegasi and Unicorns.
Problem?
Problem:
The SR Versions of Unicorn and Pegasus are Carnivorous Predators.
Something which they could not have known before hand of course.
It will all go downhill from then on i think ^^
And while the SR Troll-Horses are certainly a match in toughness and strength, there is no magical adhesive that allows the usage of hooves as hands so no tools for them either . .
There are Horse and Unicorn Shamans in SR already . . not sure about Pegasus though. So twisted/toxic versions of these might work as Insect Shamans do for Bugs.

So, technically, it's a Mix between Shedim and Insect Spirits, but in a Technicolour 4 Legged Freaks kind of way . .

On that Note: i never quite understood why HORSE Shamans got to Learn the Movement(Self) Critter Power as a Meta-Tech at Initiation . .
